EMCC UK terms and conditions of membership

 

In joining the European Mentoring and Coaching Council United Kingdom (Registered at Companies House as EMCC UK, Company number 05625451, 87 North Road, Poole Dorset BH14 0LT VAT No: 891919474) as a Subscription Member (hereafter referred to as a Member), you are agreeing to these terms and conditions. Please read them carefully.

Non-members who create an account using the Create Account on the EMCC UK website are also subject to these terms and conditions, where indicated. EMCC UK is affiliated to the European Mentoring and Coaching Council hereafter referred to as EMCC.  We provide a number of services to Members in accordance with these terms and conditions. If at any point we develop or provide additional services which have additional requirements, we will seek Member agreement to these additional requirements before these services are made available to them. Members are expected to fully adhere to the Global Code of Ethics (Global Code of Ethics Link)), specifically section 3, professional conduct. Noting that breaches of the Global Code of Ethics may result in loss of accreditation or loss of membership.

Services we provide to members

 

We provide a range of service to our Members:

A website that enables members to access a range of coaching, mentoring and supervision resources and to access membership benefits from selected suppliers. The website also provides information on professional pathways that support members and organisations to seek individual or organisational accreditations with EMCC

We host events, from time to time, in support of our purpose as an organisation to develop standards in the coaching and mentoring industry

We support a number of networks with the purpose of offering continuous professional development to coaches, mentors and supervisors, open to members and non-members

By accepting these terms and conditions, you, as a Member, agree that you will not misuse these services. As a Member you may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from EMCC UK or the identified owner (if this is not EMCC UK) or are otherwise permitted by law. These terms do grant Members the right to use any branding or logos used in our Services provided that this usage is in accordance with our brand/logo guidelines in the Member Only Offers section . Members must not remove, obscure, or alter any legal notices displayed in or along with our Services. If membership is cancelled or expires and is not renewed, Members must remove all EMCC/EMCC UK branding where these have been used. Where a member has an accreditation that is still valid beyond the end of their membership, they may continue to use the appropriate branding subject to the specific guidance associated with the award.

Please note, a new Membership or a renewal may be cancelled within 14 days from the date or joining or renewal. This is subject to our cancellation policy, which may be accessed here.

Your EMCC UK membership

 

In becoming a Member of EMCC UK, you give us permission to contact you (normally via email or telephone) in respect of membership matters. This may include (but is not limited to) membership elections, renewal communications, membership benefits, general organisational changes, membership newsletters or announcements and anything connected with the operation and administration of EMCC UK as a membership organisation. In connection with your use of EMCC UK Services, we may send you service announcements, administrative messages, and other information related to availability of such services.

You may opt out of communications in connection with:

Conferences and events, networks and forums etc.
Professional development

Services we provide to non-members

 

We enable non-members to create accounts on our web site for the purposes of booking onto events that are offered by EMCC UK nationally and through the EMCC UK network groups.

By accepting these terms and conditions, you, as a non-member, agree that you will not misuse these services. As a non-member you may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Privacy and Copyright Protection

 

EMCC UK’s privacy policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that EMCC UK can use such data in accordance with our privacy policies.

Your content in our Services – Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours. If you have an EMCC UK Membership Account, where you provide the information, you agree that we may display your Profile name, Profile photo, and Profile information to other EMCC UK members. By accessing your profile on our web site, you may remove or amend this information at any time.  When you create an account by signing up online you agree not to use any false, inaccurate or misleading information.  EMCC UK will only modify account information where it is necessary to do so in order to maintain accurate account and membership information such as duplicate records, obsolete or aborted records. Modifying and terminating our Services – You can cease to be a member at any time. This will result in access to our Services being terminated. We believe that you own your data and preserving your access to such data is important. Before we discontinue any Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service (such as Profile information). New members or members renewing their membership do have the right to cancel their Membership and request a refund. The process and conditions for requesting this are set out in our cancellation policy.

Events

 

Members and non-members booking onto events will be subject to the events cancellation policy – available here, and any event specific policies that may be set out for an individual event at the time of booking.

Our warranties and disclaimers

 

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Services.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS EMCC UK DOES NOT MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.

Liability for our Services

 

WHEN PERMITTED BY LAW, EMCC UK WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF EMCC UK, AND ITS SUPPLIERS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES. IN ALL CASES, EMCC UK WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Business uses of our Services

 

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify EMCC UK and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

About these Terms

 

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service. If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.

These terms control the relationship between EMCC UK and you. They do not create any third party beneficiary rights. If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).  If it turns out that a particular term is not enforceable, this will not affect any other terms.

Acceptance of these Terms and Conditions indicates agreement to submit to the exclusive jurisdiction of the Courts of England and Wales in respect of any dispute which arises out of or under this Agreement.
